CHAPTER 63. BOARD OF TRUSTEES

The Employees Retirement System of Texas (ERS) adopted amendments to 34 Texas Administrative Code Chapter 63 (Board of Trustees), including amendments to §63.9 (Officers) and §63.13 (Committees), without changes to the proposed text as published in the July 24, 2026 issue of the Texas Register (51 TexReg 4810). The amendments were approved by the ERS Board of Trustees at its August 26, 2026 meeting. These sections will not be republished.

Amendments have been adopted for §63.9 and §63.13 in order to reduce the number of officer positions for the ERS Board of Trustees. Currently, three of the Board's six members serve as officers, and one of the officers (the Vice Chair) rarely performs any duties. Pursuant to the newly adopted rules, the Chair of the Board and the Chair of the Internal Audit Committee will be the only officer positions, with the Chair of the Internal Audit Committee acting as the presiding member in the Board Chair's absence.

No comments were received regarding the proposed amendments.

The amendments are adopted under Tex. Gov't Code §815.102, which provides authorization for the ERS Board of Trustees to adopt rules necessary for the administration of the funds of the retirement system and regarding the transaction of any other business of the Board.

The agency certifies that legal counsel has reviewed the adoption and found it to be a valid exercise of the agency's legal authority.
